GENERAL

This document contains General Terms and Conditions, according to which the MERCHANT provides services to its users/customers through a mobile application/online store Wash Depot app. These terms and conditions bind all users of the online store. The User/Client agrees, fully accepts and undertakes to comply with these General Terms and Conditions.

Identification of the user/client in order to reproduce his/her statement both for acceptance of the General Terms and Conditions and for the order placed is carried out through the log files stored on the server of the mobile application of Wash Depot Ltd., storage of the IP address of the user/client, as well as any other information. To activate the services of the Application, the Client must download the Application and register a personal user profile, for which he/she provides information about a mobile number of a Bulgarian mobile operator owned by him/her. The application operator is not responsible for an incorrectly provided number by the customer.

The products that are on the website of the mobile application of Wash Depot Ltd. do not constitute a legally binding offer, but rather are a demonstration online catalog describing the product line of the trader.

By submitting an order for the products in the cart, users agree to purchase the goods in the cart. This action is legally binding. The customer receives a confirmation of the order and upon receipt of this confirmation, it is considered that the contract has been concluded. Ordering an order by selecting the “order” button for a service after correctly filling in your respective required data (if such are additionally necessary) is an electronic signature of the client, who in relations with WASH DEPOT LTD according to the EDEU has the legal force of a handwritten signature, through which electronic signature the user/customer enters into a distance contract with WASH DEPOT LTD for the performance of services or delivery of goods.

The MERCHANT reserves the right to refuse delivery of a confirmed order in case the goods/services are not available. In the absence of the possibility to fulfill the order, within the working week the TRADER shall notify the user/client of its exhaustion by sending a message to the e-mail address specified by the Client or to the specified telephone number. In case a transfer has been made to the merchant’s account, the client will be able to choose between a refund, cancellation of the order or through a replacement order.

The contractual language is Bulgarian, and payments will be made in Bulgarian leva with VAT. The announced prices include VAT.

RIGHTS AND OBLIGATIONS OF THE USER/CLIENT

• 7. The user/customer has the opportunity to view and order the announced goods/services on the mobile application of Wash Depot Ltd. 8. The user/customer has the right to be informed about the status of his/her order.9. The User/Client is fully responsible for the protection of his/her username and password, as well as for all actions performed by his/her or by a third party using the username and password. The User is obliged to immediately notify the TRADER of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use. The user is obliged to pay the price of his order according to the announced method on the website of the mobile application of Wash Depot Ltd.11. Each user, regardless of whether he is a client of the TRADER, is obliged to use the services:

• Not to violate and respect the fundamental rights and freedoms of citizens and human rights, in accordance with the Constitution and laws of the Republic of Bulgaria and recognized international acts;
• Not to damage the good name of another and not to call for a violent change of the constitutionally established order, for the commission of a crime, for violence against the person or for incitement to racial, national, ethnic or religious enmity;
• Not to violate other people’s property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
• To comply with the Bulgarian legislation, the applicable foreign laws, the rules of morality and good morals and Internet ethics when using the services provided by the mobile application of Wash Depot Ltd.;
• To immediately notify the TRADER of any case of committed or discovered violation in the use of the services provided;
• Not load, send, transmit, distribute, or use in any way or make available to any third party any software, computer programs, files, applications, or other material containing computer viruses, unauthorized remote control systems (“Trojan horses”), computer code, or material intended to interrupt, impede, disrupt, or restrict the normal functioning of computer hardware or software or telecommunications facilities, or for the purpose of unauthorized penetration or access to foreign resources or software;
• Not to commit malicious actions;
• Insofar as it does not contradict the imperative provisions of the applicable law, to indemnify the TRADER and all third parties for all damages and lost profits, including for any costs and paid attorneys’ fees, incurred as a result of claims filed by and/or paid compensations to third parties in connection with Internet pages, hyper-links, materials or information that the User has used,  located on the server, sent, distributed, made available to third parties or made available through the mobile application of Wash Depot Ltd. in violation of the law, these General Terms and Conditions, Good Morals or Internet ethics; 11a. By placing an order on the mobile application by selecting the “order” button for a given product or service, after correctly filling in the necessary data, the user/client enters into a distance contract with the trader. As a consumer within the meaning of the Consumer Protection Act, the consumer/customer has the right to withdraw from the distance contract within the statutory period without specifying a reason, without owing compensation or penalty, in case the legal requirements are met.

RIGHTS AND OBLIGATIONS OF THE TRADER

12. The TRADER does not have the obligation and objective opportunity to control the way users use the services provided. The MERCHANT has the right, but not the obligation, to store materials and information located on the server of Wash Depot app.14. The MERCHANT has the right at any time, without notifying the user/client, when the latter uses the services in violation of these terms and conditions, as well as at the discretion of the MERCHANT, to terminate, suspend or change the services provided in connection with the use of the site. The MERCHANT shall not be liable to users and third parties for damages and lost profits resulting from the termination, suspension, modification or limitation of the services, deletion, modification, loss, unreliability, inaccuracy, or incompleteness of messages, materials or information transmitted, used, recorded or made available through the Wash Depot app.15. Upon receipt of the payment, the TRADER undertakes to perform within a reasonable time the service requested and ordered by the user/client16. The MERCHANT is not responsible for damages caused to software, hardware or telecommunication facilities, or for loss of data resulting from materials or resources searched, loaded or used in any way through the services provided. 17. The MERCHANT has the right to collect and use information relating to its Users/clients and related to the services provided by it, regardless of whether they are registered. 18. The information under the previous article may be used by the MERCHANT, except in case of explicit disagreement of the User, sent to the following e-mail address office@washdepot.bg the MERCHANT Philips collects and uses the information to improve the services offered. All purposes for which the TRADER will use the information will be in accordance with the Bulgarian legislation, applicable international acts and good morals. The MERCHANT shall not be liable for non-fulfillment of its obligations under this contract in the event of circumstances that  the MERCHANT has not foreseen and was not obliged to foresee – incl., cases of accidental events, problems in the global network of the Internet and in the provision of services beyond the control of the MERCHANT.20. The MERCHANT has the right to install cookies on the computers of the users. Cookies are text files that are saved from the website on the User’s hard drive and allow the recovery of information about the User by identifying him and allowing tracking of his actions, the Internet pages he visits, the hyperlinks he uses, the information he uses and saves, etc. Depot app.

• The Wash Depot app automatically allows cookies to be stored. These settings can be changed so that the automatic saving of cookies is stopped. Restricting cookies will make ordering impossible.

PERSONAL DATA

22. The MERCHANT guarantees to its Users/Clients the confidentiality of the information and personal data provided. The latter will not be used, provided or brought to the attention of third parties except in the cases and under the conditions specified in these General Terms and Conditions. The MERCHANT protects the personal data of the user/client, which became known to him when filling in the electronic form for making a purchase application, and this obligation is abolished in case the Client has provided false data. In compliance with the current legislation and the clauses of these General Terms and Conditions, the MERCHANT may use the Client’s personal data only for the purposes provided for in the contract. Any other purposes for which the data are used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good morals. The MERCHANT undertakes not to disclose any personal data about the Client to third parties – state authorities, commercial companies, individuals and others, except in cases where he has received the explicit written consent of the Client, the information is requested by state authorities or officials, who, according to the current legislation, are authorized to request and collect such information. The MERCHANT is obliged to provide the information by virtue of the law. 24. The Client is responsible for an unauthorized attempt to access someone else’s user profiles, record and/or share someone else’s user information. The Client undertakes not to make malicious attempts to interrupt any functionality of the Application, not to distribute files with viruses and software that can be used for unauthorized access,  modifying, deleting, or damaging data files.

25. 
    “User/client” means anyone who has loaded the Wash Depot app on their computer 26. “Order” means the selected goods, services and/or all other attributes related to the method of delivery and payment for the goods by the customer/user. 27. The Wash Depot app online store is owned by the MERCHANT.28. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In case no agreement is reached, all unresolved disputes, including disputes arising from or relating to its interpretation, invalidity, performance or termination, as well as disputes for filling in gaps in the contract or its adaptation to newly arisen circumstances, will be resolved by the competent court of registration of the TRADER, in accordance with the Bulgarian legislation. “OPERATOR’S SITE” is the Operator’s website www.washdepot.bg30. “CLIENT PROFILE” is the personal electronic profile of the Client, activated in the Operator’s Application, where the information about the accumulated and used services, as well as other information necessary to use the functionalities of the Application and/or provided by the Client at his request is registered and stored in electronic form; “PREPAID PACKAGES” is an electronic profile in which you can see all the prepaid packages offered by the company and the terms of their use. Each package contains information about its amount and validity, and according to the package, different discounts and validity periods are used. After the expiration of the package, the amount remaining in it is lost, cannot be transferred or replaced. package.32. “DESCRIPTION OF SERVICES” is an electronic profile in which you can see all the services offered by the company, a description of what they contain and the respective price. 33. “DESCRIPTION OF REQUESTS” is an electronic profile where you can make a reservation for the time, date and relevant service, as you can pay through the application through a virtual POS terminal.34. PAYMENT is  made through the application through a virtual MYPOS POS terminal  or on the spot in cash or by card, and a corresponding document is issued for each payment. 35. Intellectual property rights – all aspects of the Wash Depot app, including its design, content, product names, companies, specified trade names and functionalities, are protected by their corresponding intellectual property rights.  protected by intellectual property rights without the prior written approval of the Operator, is prohibited.36. After registering in the Mobile Application, you have the right to give your consent to receive commercial messages from WASH DEPOT Ltd., including advertising and other messages directly or indirectly presenting the services and reputation of the provider, in the form of banners, messages and notifications, short text messages (SMS) and e-mail. Information providing direct access to the provider’s activities, such as the name of its domain name or email address. mail, as well as messages about the services and reputation of “WASH DEPOT”, 38. The User/Client agrees to provide the Wash Depot app with phone location data in order to indicate the nearest Operator’s location. The User/Client may prohibit the provision of location data, but in this case the Operator cannot guarantee the proper functioning of the Wash Depot app, as well as the correct reflection of the orders placed. The Operator reserves the right to update the content and functionalities of the Application by providing the Client with access to a subsequent, improved version of it.40. In the process of use, the Application generates mobile data traffic, which will be charged according to the Client’s mobile service plan.41. Communication between the parties – all communication between the Operator and the Client will be carried out in Bulgarian, and depending on the nature of the exchanged messages/confirmations/documents will be visualized directly on a screen in the Application or sent to an e-mail address specified by the Client, or as the Operator and the Client accept that for the purposes of the Agreement any electronic statement,  emanating from/located on the Application shall be deemed to have been made by the Operator, respectively any electronic statement emanating from the e-mail address (e-mail) and/or mobile phone provided by the Client in the process of creating the Client’s Profile shall be considered outgoing by the Client42. The General Terms and Conditions may be changed at any time by the MERCHANT, who has the right to change the characteristics of the services provided and these General Terms and Conditions and on the basis of changes in legislation. The MERCHANT undertakes to notify the User of the changes in the General Terms and Conditions by publishing a notice of their amendments in a prominent place on its website and giving sufficient time to familiarize himself with them.  if he does not agree with the changes, the MERCHANT has the right to immediately suspend or terminate the provision of services to the User.
